Your rights when you’re injured in a car or auto accident

If you have been injured in a car or automobile accident you have the right to financial compensation.

These following personal injury terms can form the basis of a financial claim after a car accident:

  • If you have your own car and are insured you have a right to collect lost wages and medical bills under your own insurance policy up to a limit of $8,000.
  • If the accident was caused by a third person and you were injured, suffering a fracture, permanent disfigurement or have medical bills for treatment that exceed $2,000 you have the right to make a claim against the person or persons who caused the accident.
  • If that person was driving a vehicle that they did not own at the time of the accident, you may be able to recover from both the owner of the vehicle involved in the accident and the person who was driving the vehicle and caused the accident.

In some cases the person who caused the accident, or the owner of the vehicle, or both, has either no insurance, or there is not enough insurance to cover the cost of your entire claim.  In that case you may be able to recover money under your own insurance policy if you purchased underinsurance coverage.
